1. Introduction

Gunnison Gear LLC, a Missouri limited liability company doing business as Off Trail Market (“OTM,” “we,” “us,” or “our”) is committed to protecting the privacy of everyone who uses our Platform. This Privacy Policy explains what personal information we collect, how we use and share it, how we protect it, and what choices you have regarding your information.

This Privacy Policy applies to all users of the Platform, including buyers, vendors, Outfitter service providers, and community forum participants. It covers our website at offtrailmarket.com, our vendor dashboard, the Basecamp community forum, and any other services we offer (collectively, the “Platform”).

By using the Platform, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Platform

2. Information We Collect

We collect information in several ways: information you provide directly to us, information collected automatically when you use the Platform, and information received from third parties.

2.1 Information You Provide Directly

Account Registration

When you create an account, we collect:

  • Full name.
  • Email address.
  • Username and password (passwords are stored in encrypted form).
  • Mailing or shipping address.
  • Phone number (optional, or required for certain vendor functions).

Vendor Onboarding

When you register as a vendor, we collect additional information, including:

  • Business name and type.
  • Employer Identification Number (EIN) or Social Security Number (SSN), collected and processed by Stripe for tax reporting and identity verification purposes.
  • Bank account information for payouts, collected and stored by Stripe (not by Off Trail Market directly).
  • Shop description, policies, and branding assets.
  • Product listings, photographs, and pricing information.

Purchases and Transactions

When you make a purchase on the Platform, we collect:

  • Order details, including items purchased, quantities, and pricing.
  • Shipping address.
  • Payment information — note that full payment card details are processed and stored by Stripe, not by Off Trail Market. We receive only limited transaction identifiers and confirmation data from Stripe.

The Outfitter Bookings

When you book a service through The Outfitter, we collect:

  • Booking details, including service type, date, group size, and participant information as required by the service provider.
  • Deposit and payment information (processed by Stripe).
  • Any additional information required by the Outfitter to facilitate your experience.

Communications

When you contact us or communicate through the Platform, we collect:

  • Messages sent through our contact forms or support channels.
  • Messages sent between buyers and vendors through the Platform’s messaging system.
  • Feedback, reviews, and ratings you submit.

Community forum posts and comments submitted through Basecamp.

2.2 Information Collected Automatically

When you use the Platform, we and our service providers automatically collect certain technical and usage information, including:

  • Pages visited, links clicked, and features used.
  • Search queries entered on the Platform.
  • Time spent on pages and navigation patterns.
  • Referring URLs (the page you came from before visiting the Platform).

  • Analytics providers: Aggregated usage and performance data about how users interact with the Platform.

3. How We Use Your Information

We use the information we collect for the following purposes:

3.1 Operating the Platform

  • Creating and managing your account.
  • Processing purchases, payments, and refunds.
  • Facilitating order fulfillment between buyers and vendors.
  • Processing Outfitter bookings and deposits.
  • Generating and managing shipping labels.
  • Operating the Basecamp community forum.

3.2 Communicating with You

  • Sending order confirmations, shipping updates, and receipts.
  • Responding to customer support inquiries.
  • Notifying you of changes to your account, our policies, or the Platform.
  • Sending marketing and promotional communications (with your consent where required by law — see Section 9 for opt-out options).
  • Sending vendor-specific communications regarding account status, policy updates, and payout information.

3.3 Improving the Platform

  • Analyzing usage patterns to improve site functionality and user experience.
  • Conducting research and development on new features and services.
  • Diagnosing technical issues and bugs.
  • Testing and optimizing Platform performance.

3.4 Safety, Security, and Fraud Prevention

  • Detecting, investigating, and preventing fraudulent transactions, chargebacks, and other harmful activity.
  • Verifying vendor identity and compliance with Platform requirements.
  • Enforcing our Terms of Service, Vendor Agreement, and Acceptable Use Policy.
  • Protecting the rights, property, and safety of Off Trail Market, our users, and the public.

3.5 Legal and Compliance

  • Complying with applicable laws, regulations, and legal processes.
  • Fulfilling tax reporting obligations, including issuing 1099-K forms to vendors.

  • Establishing, exercising, or defending legal claims.

4. How We Share Your Information

We do not sell your personal information to third parties. We share your information only in the circumstances described below.

4.1 With Vendors (for Order Fulfillment)

When you place an order, we share your name, shipping address, order details, and contact information with the vendor fulfilling your order. Vendors receive only the information necessary to fulfill and support your transaction. Vendors are prohibited under our Vendor Agreement from using your personal information for any purpose other than fulfilling your order.

4.2 With Buyers (for Vendor Transparency)

Vendor shop names, general location (city or region, not full address), and publicly listed policies are visible to buyers on the Platform. Vendor personal contact information is not displayed publicly.

4.3 With Service Providers

We share information with trusted third-party service providers who assist us in operating the Platform, subject to appropriate confidentiality obligations. Current service providers include:

  • Stripe: Payment processing, vendor payouts, identity verification, and tax reporting.
  • Shippo: Shipping label generation and carrier integrations.
  • Hostinger: Web hosting and server infrastructure.
  • Microsoft 365: Email and administrative communications.
  • Analytics providers: Aggregated site usage analysis (Google Analytics).
  • wpForo: Community forum software for Basecamp.

We may update this list as our service provider relationships change. Significant new service providers that materially affect how your data is used will be reflected in an updated Privacy Policy.

4.4 With Outfitter Service Providers

When you book an experience through The Outfitter, we share your booking details, contact information, and any participant information you provide with the applicable Outfitter service provider. This sharing is necessary to facilitate your booking and the experience itself

4.5 For Legal Reasons

We may disclose your information if we believe in good faith that disclosure is necessary to:

  • Comply with a legal obligation, court order, or government request.
  • Enforce our Terms of Service or Vendor Agreement.
  • Protect the rights, property, or safety of Off Trail Market, our users, or others.

Detect, prevent, or address fraud, security, or technical issues.

4.6 Business Transfers

We may share your information for other purposes if you have provided explicit consent.

4.7 With Your Consent

We may disclose your information if we believe in good faith that disclosure is necessary to:

  • Enforce our Terms of Service or Vendor Agreement.
  • Protect the rights, property, or safety of Off Trail Market, our users, or others.

Detect, prevent, or address fraud, security, or technical issues.

5. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  • Account information is retained for as long as your account is active and for a reasonable period thereafter to allow for account reactivation, dispute resolution, and legal compliance.
  • Transaction records, including order history and payment data, are retained for a minimum of seven (7) years to comply with tax and financial recordkeeping requirements.
  • Vendor tax and payout records are retained as required by applicable tax law and IRS reporting obligations.
  • Communications and support records are retained for one (1) year following the resolution of your inquiry.
  • Usage and analytics data may be retained in aggregated, de-identified form indefinitely.

When your information is no longer needed, we delete it or anonymize it in accordance with our data retention practices. You may request deletion of your account and associated data as described in Section 7 below.

6. Data Security

We take the security of your personal information seriously and implement reasonable administrative, technical, and physical safeguards to protect it from unauthorized access, disclosure, alteration, and destruction.

Security measures include:

  • Encrypted transmission of data using SSL/TLS protocols.
  • Encrypted storage of account passwords.
  • Access controls limiting employee and contractor access to personal data on a need-to-know basis.
  • Use of PCI-compliant payment processing through Stripe, meaning Off Trail Market does not store full payment card numbers on its own servers.
  • Regular review of security practices and vendor compliance.

No method of data transmission or storage is completely secure. While we work to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your rights or interests, we will notify you as required by applicable law.

7. Your Rights and Choices

Depending on where you are located, you may have certain rights regarding your personal information. Where required by applicable law, we will honor these rights. Where not legally required, we will endeavor to honor similar requests where feasible and consistent with our operational capabilities.

7.1 Access and Correction

You may access and update most of your account information directly through your account settings. If you need assistance accessing or correcting information that is not editable through your account, please contact us at Admin@OffTrailMarket.com.

7.2 Deletion

You may request deletion of your account and associated personal information by contacting us at Admin@OffTrailMarket.com. We will process deletion requests subject to the following:

  • Some information may be retained as required by law, including tax records and transaction history.
  • Information necessary to resolve open disputes, chargebacks, or legal claims may be retained until those matters are resolved.
  • Aggregated or de-identified data derived from your information may be retained even after account deletion.

Content you posted publicly in Basecamp may remain visible unless you separately request its removal.

7.3 Opt-Out of Marketing Communications

You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at Admin@OffTrailMarket.com. Note that even if you opt out of marketing communications, we will continue to send you transactional and account-related messages (such as order confirmations, shipping updates, and policy notices).

7.4 Cookie Preferences

You may manage cookie preferences through your browser settings or through our cookie consent tool (see Section 8). Note that disabling certain cookies may affect Platform functionality.

7.5 California Residents -- CCPA Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

  • The right to know what personal information we collect, use, share, and sell.
  • The right to delete personal information we have collected about you, subject to certain exceptions.
  • The right to correct inaccurate personal information.
  • The right to opt out of the sale or sharing of your personal information, including sharing for purposes of cross-context behavioral advertising. Off Trail Market does not sell personal information. We do not currently share personal information for cross-context behavioral advertising. If either practice changes, we will update this Policy and provide opt-out mechanisms, including honoring Global Privacy Control (GPC) signals as a valid opt-out request where required by applicable law.
  • The right to limit the use and disclosure of sensitive personal information.
  • The right not to be discriminated against for exercising your privacy rights.

7.6 Colorado, Connecticut, Virginia, and Other State Privacy Laws

If you are a resident of Colorado, Connecticut, Virginia, or another state with an applicable consumer privacy law, you may have rights similar to those described above, including the right to access, correct, delete, and opt out of certain processing of your personal information. If we deny a privacy rights request in whole or in part, you may appeal that decision by contacting us at Admin@OffTrailMarket.com within 45 days of receiving our response. Please include the original request, our response, and a description of why you believe the denial was incorrect. We will review your appeal and respond within the timeframe required by applicable law. If your appeal is denied, we will provide information on how to contact the relevant state attorney general or privacy regulator to submit a complaint.

7.7 European Users -- GDPR

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you may have rights under the General Data Protection Regulation (GDPR) or equivalent legislation, including:

8.1 What Are Cookies

8.4 Do Not Track and Global Privacy Control

Some browsers send “Do Not Track” (DNT) signals. The Platform does not currently respond to Do Not Track signals as there is no industry standard for how such signals should be honored.  Global Privacy Control. Where required by applicable law — including the California Privacy Rights Act and certain other state privacy laws — Off Trail Market recognizes Global Privacy Control (GPC) signals as a valid request to opt out of the sale or sharing of your personal information, including sharing for cross-context behavioral advertising. GPC is a browser-level signal that can be enabled through supported browsers and extensions. Where OTM deploys targeted advertising or analytics that constitute sharing under applicable law, GPC signals will be honored at the browser level. If you have a registered account, you may also update your privacy preferences directly through your account settings or by contacting us at Admin@OffTrailMarket.com.

9. Marketing Communications

With your consent where required, we may send you marketing emails about new products, promotions, vendor spotlights, and Platform updates. You can opt out of marketing emails at any time by:

  • Clicking the “unsubscribe” link in any marketing email.
  • Contacting us at Admin@OffTrailMarket.com.

Vendors may also receive communications about Platform updates, fee changes, policy notices, and opportunities to participate in promotional features. Some of these communications are considered operational and may be sent even if you have opted out of general marketing.

10. Children's Privacy

The Platform is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, do not use the Platform or provide any personal information.

If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe we may have collected information from a child under 13, please contact us at Admin@OffTrailMarket.com.

11. Third-Party Links and Services

The Platform may contain links to third-party websites, social media platforms, or services that are not operated by Off Trail Market. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you visit. Off Trail Market is not responsible for the privacy practices of third parties.

12. Payment Data and PCI Compliance

Off Trail Market uses Stripe as its payment processor. Payment card information is entered directly into Stripe’s secure payment interface and is not transmitted to or stored on Off Trail Market’s servers. Stripe is certified as a PCI DSS Level 1 service provider, which is the highest level of payment security certification available.

By making a purchase or receiving payouts on the Platform, you are also subject to Stripe’s Privacy Policy, available at stripe.com/privacy.

13. Vendor-Specific Privacy Considerations

Vendors have access to buyer information (name, shipping address, order details) solely for the purpose of fulfilling orders. Vendors are prohibited from:

  • Using buyer information for any purpose other than order fulfillment and associated customer service.
  • Contacting buyers outside of the Platform’s messaging system for marketing or solicitation purposes.
  • Storing buyer personal information beyond the period necessary to fulfill and support the transaction.
  • Sharing buyer information with any third party not directly involved in fulfilling the order.

Vendor violations of these requirements may result in account suspension or termination and may subject the vendor to legal liability.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or Platform features. When we make material changes, we will:

  • Post the updated Privacy Policy on the Platform with a new effective date.
  • Notify registered users via email or through a prominent notice on the Platform prior to the changes taking effect.

Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Privacy Policy. If you do not agree to the updated Policy, please stop using the Platform and close your account.
