Two sets of terms apply to every booking: These Platform Booking Terms govern the relationship between you, the Outfitter service provider, and Off Trail Market. In addition, each individual Outfitter sets their own service-specific terms covering pricing, cancellation, included services, and participant requirements. Both sets of terms apply to your booking. Review the Outfitter’s specific terms carefully before completing your reservation. These Outfitter Booking Terms are the controlling document for all bookings made through The Outfitter. In the event of any conflict between these Booking Terms and the Off Trail Market Return and Refund Policy regarding a booking, these Booking Terms control. The Return and Refund Policy governs physical product purchases through the Gear Shop and Makers Market.
1. About The Outfitter
The Outfitter is a section of the Off Trail Market Platform that connects guests with independent outfitters, hunting guides, fishing charters, wilderness experience providers, and other outdoor service professionals (collectively, “Outfitters”). Through The Outfitter, guests can browse, book, and pay for guided outdoor experiences directly through the Platform.
Off Trail Market provides the booking infrastructure, payment processing, and platform through which these connections are made. Off Trail Market is not itself an outfitter, guide service, or experience operator. Off Trail Market does not employ or supervise Outfitters, does not participate in the planning or execution of any experience, and does not have operational control over how any experience is conducted.
Outfitters are independent third-party businesses or individuals. They are solely responsible for the design, operation, safety, legality, and quality of the experiences they offer. Off Trail Market makes no representations, warranties, or guarantees regarding any Outfitter or any experience offered through The Outfitter.
2. Who These Terms Apply To
These Booking Terms apply to:
- Guests: Any individual who browses, inquires about, books, or participates in an experience offered through The Outfitter.
- Outfitters: Any individual or business that lists, offers, or provides experiences through The Outfitter section of the Platform.
- Participants: Any individual who participates in a booked experience, whether or not they personally made the booking.
If you are booking on behalf of a group, you represent and warrant that you have the authority to bind all adult participants in your group to these Booking Terms, and that all participants have been informed of and have agreed to the terms applicable to the experience, including any waivers or assumption of risk acknowledgments required by the Outfitter. The authority conferred by this clause applies to adult participants only and does not extend to binding minor participants for liability waiver or assumption-of-risk purposes.
Minor Participants. If any participant in a booked experience is under 18 years of age, the booking must be made by that participant’s parent or legal guardian. By completing a booking that includes a minor participant, the parent or legal guardian: (a) represents that they have the legal authority to make decisions on behalf of the minor; (b) agrees to these Booking Terms on behalf of the minor and themselves; (c) agrees to execute any liability waiver or assumption-of-risk acknowledgment required by the Outfitter on behalf of the minor before the experience begins; and (d) acknowledges that the enforceability of waivers executed on behalf of minors varies by state law and that signing such a waiver does not guarantee its enforceability. Outfitters may establish minimum age requirements for specific experiences and may refuse participation by minors who do not meet those requirements. Off Trail Market is not responsible for verifying the age of participants prior to an experience.
3. The Booking Process
3.1 Browsing and Selecting an Experience
Guests may browse available experiences through The Outfitter section of the Platform. Each listing includes information provided by the Outfitter about the experience, including description, pricing, availability, location, duration, group size limits, physical requirements, and any other relevant details. Off Trail Market does not independently verify all information contained in Outfitter listings, though we review listings for compliance with our Acceptable Use Policy before they are published.
3.2 Reviewing Outfitter Terms Before Booking
Before completing a booking, guests must review the individual Outfitter’s service terms, which are displayed during the booking process. These terms govern:
- What is included and excluded from the experience.
- Deposit requirements and payment schedule.
- Cancellation and refund policy.
- Participant requirements, including any physical fitness, age, licensing, or equipment requirements.
- Any liability waivers or assumption of risk acknowledgments required by the Outfitter.
- Any other conditions specific to the experience.
By completing a booking, you confirm that you have read, understood, and agreed to the Outfitter’s service terms in addition to these Platform Booking Terms.
3.3 Booking Confirmation
A booking is confirmed when:
- You complete the booking form and provide all required participant information.
- You review and accept the Outfitter’s service terms and these Platform Booking Terms.
- You authorize payment of the required deposit or full payment through the Platform’s payment system.
- You receive a booking confirmation email from Off Trail Market.
A booking is not confirmed until all four steps above are complete. Availability shown during browsing is not guaranteed until a booking confirmation is issued.
3.4 Booking Requests vs. Instant Booking
Depending on the Outfitter’s configuration, experiences may be available as either:
- Instant Booking: Your booking is confirmed immediately upon completing payment authorization.
- Booking Request: Your booking request is submitted to the Outfitter for review. The Outfitter has 5 days to accept or decline. Payment authorization is held but not captured until the Outfitter accepts. If the Outfitter declines or does not respond within the review window, your payment authorization is released in full.
The booking type applicable to a given listing will be clearly indicated on the listing page before you begin the booking process.
4. Pricing and Payment
4.1 Pricing
All prices displayed on The Outfitter are set by the individual Outfitter and are denominated in U.S. dollars unless otherwise stated. Prices may vary based on group size, season, trip dates, or other factors disclosed by the Outfitter. The total price for your booking, including any applicable taxes or Platform service fees, will be displayed clearly before you confirm payment.
4.2 Platform Service Fee
Off Trail Market may charge a service fee on bookings made through The Outfitter. Where applicable, this fee will be disclosed to the guest at checkout and to the Outfitter in their payout summary. The service fee supports the booking infrastructure, payment processing, and customer support services provided by the Platform.

4.3 Deposits
Many Outfitters require a deposit at the time of booking, with the remaining balance due closer to the trip date. Deposit amounts, due dates for remaining balances, and the consequences of non-payment are set by each Outfitter and disclosed during the booking process.
If you fail to pay a required balance by the Outfitter’s stated due date, the Outfitter may cancel your booking in accordance with their cancellation policy. In such cases, your deposit may be forfeited depending on the Outfitter’s terms.
4.4 Payment Processing
All payments are processed through Stripe, Off Trail Market’s payment processor. By completing a booking, you authorize Off Trail Market to charge your payment method for the deposit or full payment as disclosed during checkout. Outfitter payouts are processed through Stripe Connect in accordance with the Vendor Agreement.
Off Trail Market does not store full payment card details. By making a payment, you are also subject to Stripe’s Terms of Service and Privacy Policy.
4.5 Currency and Taxes
All prices are in U.S. dollars unless otherwise specified. Applicable taxes will be calculated and added at checkout where required by law. Guests are responsible for any taxes, duties, or fees imposed by their own jurisdiction in connection with the booking or experience.
5. Cancellations and Refunds
These Outfitter Booking Terms are the controlling document for cancellations and refunds arising from bookings made through The Outfitter. In the event of any conflict between this Section 5 and the Off Trail Market Return and Refund Policy regarding a booking, these Booking Terms control. The platform minimum standards in Section 7 of the Return and Refund Policy apply alongside these terms as a floor and do not supersede them. For physical product returns and refunds through the Gear Shop or Makers Market, the Return and Refund Policy is the controlling document.
5.1 Outfitter Cancellation Policies
Each Outfitter sets and discloses their own cancellation and refund policy. These policies vary between providers and reflect the real costs that Outfitters incur when bookings are cancelled — including permit fees, guide contracts, equipment reservations, and logistics planning. Common policy structures include tiered refund schedules based on how far in advance a cancellation is made.
The Outfitter’s cancellation policy will be displayed clearly during the booking process and in your booking confirmation. You are responsible for reviewing and understanding the cancellation policy before completing your booking.
5.3 Outfitter-Initiated Cancellations
If an Outfitter cancels a confirmed booking for any reason, guests are entitled to a full refund of all amounts paid, including any non-refundable deposit. In addition, Off Trail Market will make reasonable efforts to assist the guest in finding an alternative experience, though we cannot guarantee availability of comparable alternatives.
Outfitters who cancel confirmed bookings are subject to account review and may face consequences under the Vendor Agreement, including restrictions on future bookings and suspension from The Outfitter.
5.4 Exceptional Circumstances
Off Trail Market recognizes that genuinely exceptional circumstances may prevent a guest from attending a booked experience. Exceptional circumstances include:
- Documented serious illness or injury to the guest or an immediate family member that prevents participation, supported by medical documentation.
- Death of an immediate family member within 10 days of the trip date.
- Government-declared emergencies or travel restrictions that make attending the experience impossible.
- Natural disasters that render travel to the experience location unsafe or impossible.
In the event of exceptional circumstances, guests should contact Off Trail Market at Admin@OffTrailMarket.com as soon as possible with documentation of the circumstances. Off Trail Market will work with the Outfitter to seek a fair resolution, which may include a full refund, a credit toward a future booking, or rescheduling. Off Trail Market does not guarantee a specific outcome but will mediate in good faith.
5.5 No-Shows
If a guest fails to appear for a booked experience without cancelling in advance, the booking is considered a no-show. No-shows are not eligible for refund. The Outfitter’s deposit and any balance paid are forfeited in full. Off Trail Market does not intervene in no-show situations.
5.6 Refund Processing
Approved refunds are returned to the original payment method. Once a refund is initiated, please allow 5 to 10 business days for the amount to appear on your statement, depending on your financial institution. Off Trail Market is not responsible for delays in refund posting caused by financial institutions.
6. Force Majeure and Weather
6.1 Weather and Outdoor Conditions
Outdoor experiences are inherently subject to weather and environmental conditions. Many experiences — particularly hunting trips, fishing charters, and wilderness expeditions — may be affected or made impossible by adverse weather, drought, flooding, wildfire, animal migration patterns, or other natural conditions beyond anyone’s control.
Weather-related cancellations and modifications are governed by the individual Outfitter’s policy, which should be reviewed carefully before booking. Not all Outfitters offer full refunds for weather-related cancellations, and some may offer rescheduling rather than refunds.
Off Trail Market encourages guests to purchase travel insurance that includes coverage for trip cancellation due to weather or natural conditions if this risk is a concern.
6.2 Force Majeure Events
Neither Off Trail Market nor the Outfitter will be held liable for failure to perform obligations under a booking due to events beyond their reasonable control, including but not limited to:
- Natural disasters, including floods, wildfires, earthquakes, hurricanes, or severe storms.
- Government actions, regulations, or restrictions, including wildlife management closures, access restrictions, or emergency declarations.
- Acts of war, terrorism, civil unrest, or strikes.
- Pandemic, epidemic, or public health emergency declarations.
- Utility failures or infrastructure disruptions affecting access to the experience location.
In the event of a force majeure situation, Off Trail Market will work with both parties to seek a fair resolution. This may include rescheduling, partial refund, or issuance of a credit. Full refunds in force majeure situations are not guaranteed and depend on the specific circumstances and any costs already incurred by the Outfitter.
7. Assumption of Risk and Safety
Please Read Carefully: This section contains important information about the risks associated with outdoor experiences and limits your ability to make claims against Off Trail Market. Read this section in full before completing a booking.
7.1 Inherent Risks of Outdoor Activities
Outdoor activities, including but not limited to hunting, fishing, hiking, camping, wildlife observation, backcountry travel, and guided wilderness experiences, involve inherent risks that cannot be fully eliminated. These risks include:
- Physical injury, including cuts, bruises, broken bones, sprains, and more serious injuries.
- Illness or medical emergencies, including those caused by altitude, heat, cold, or remote location.
- Drowning, hypothermia, heat stroke, or other environmental exposure risks.
- Injury from wildlife, including bites, stings, or encounters with dangerous animals.
- Injury from the use of equipment, including firearms, bows, knives, boats, horses, ATVs, and other tools used in outdoor activities.
- Getting lost, stranded, or separated from a guide in remote terrain.
- Property damage or loss.
These risks exist regardless of the skill or experience level of the Outfitter and cannot be entirely prevented by proper planning or precaution. They are an inherent part of the outdoor activities available through The Outfitter.
7.2 Voluntary Assumption of Risk
BY COMPLETING A BOOKING THROUGH THE OUTFITTER, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH THE BOOKED EXPERIENCE, INCLUDING THE INHERENT RISKS DESCRIBED IN SECTION 7.1, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. You acknowledge that you are participating voluntarily and that your participation is your own free choice.
7.3 Outfitter Liability Waivers
Many Outfitters require participants to sign a separate liability waiver or release of claims before participating in an experience. These waivers are agreements between you and the Outfitter and are separate from these Platform Booking Terms. Off Trail Market may facilitate the presentation of waivers through the booking process but is not a party to them.
You are responsible for reading any Outfitter waiver carefully before signing. If you are unwilling to sign a required waiver, the Outfitter may refuse to allow you to participate. In that event, refund eligibility will be governed by the Outfitter’s cancellation policy.
7.4 Participant Physical Fitness and Health
Many outdoor experiences require a baseline level of physical fitness, health, or ability. Outfitters may disclose minimum physical requirements in their listings. It is your responsibility to:
- Honestly assess whether you and all participants in your group meet the physical requirements for the experience.
- Disclose any health conditions, physical limitations, or medications that may affect your safety or participation to the Outfitter prior to the experience.
- Consult your physician before booking or participating in any experience if you have concerns about your fitness or health.
Off Trail Market and Outfitters are not liable for injury or illness resulting from a participant’s failure to disclose relevant health information or to honestly assess their own fitness for an activity.
7.5 Licensing and Legal Requirements
Many outdoor experiences, including hunting and fishing trips, require participants to hold valid licenses, tags, permits, or stamps issued by the applicable state or federal wildlife agency. It is the sole responsibility of each participant to:
- Obtain all required licenses, tags, and permits before the experience date.
- Carry required documentation during the experience.
- Comply with all applicable wildlife regulations, including bag limits, season dates, weapon restrictions, and species-specific rules.
Outfitters may provide guidance on licensing requirements but are not responsible for a participant’s failure to obtain required documentation. Off Trail Market is not responsible for any legal consequences arising from a participant’s failure to comply with applicable licensing or wildlife regulations.
7.6 Equipment and Gear
Unless otherwise specified in the Outfitter’s listing, participants are responsible for providing their own personal gear and equipment appropriate for the experience, including appropriate clothing, footwear, safety equipment, and any personal firearms or archery equipment where applicable.
Where the Outfitter provides equipment, participants must use that equipment only as directed by the Outfitter and in accordance with applicable safety standards. Participants are financially responsible for damage to Outfitter-provided equipment caused by negligence or misuse.
8. Off Trail Market's Role and Limitation of Liability
8.1 Platform Role Only
Off Trail Market’s role is limited to providing the booking platform that connects guests with Outfitters. Off Trail Market does not:
- Organize, operate, supervise, or participate in any experience.
- Employ, train, certify, or supervise any Outfitter or guide.
- Independently verify the accuracy of all information in Outfitter listings.
- Guarantee the quality, safety, legality, or outcome of any experience.
Assume responsibility for acts or omissions of Outfitters or their staff.
8.2 No Endorsement
The listing of an experience on The Outfitter does not constitute an endorsement, recommendation, or warranty by Off Trail Market regarding that experience or Outfitter. Guests book experiences based on their own independent judgment, review of Outfitter listings and terms, and any direct communications with the Outfitter.
8.3 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OFF TRAIL MARKET SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, LOSS, OR OTHER HARM ARISING FROM OR IN CONNECTION WITH ANY EXPERIENCE BOOKED THROUGH THE OUTFITTER, INCLUDING HARM CAUSED BY THE ACTS OR OMISSIONS OF ANY OUTFITTER, GUIDE, OR OTHER THIRD PARTY.
OFF TRAIL MARKET’S TOTAL LIABILITY TO ANY GUEST FOR CLAIMS ARISING FROM A BOOKING OR EXPERIENCE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE GUEST TO OFF TRAIL MARKET FOR THAT SPECIFIC BOOKING. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF OFF TRAIL MARKET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.4 Indemnification by Guest
You agree to indemnify, defend, and hold harmless Off Trail Market and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your participation in any experience booked through The Outfitter.
- Your violation of these Booking Terms or applicable law.
- Your failure to obtain required licenses, permits, or authorizations.
- Any harm caused to other participants, the Outfitter, or third parties by your actions during an experience.
8.5 Savings Clause
Nothing in these Booking Terms limits or excludes liability to the extent such limitation or exclusion is prohibited by applicable law. This includes, without limitation, liability for gross negligence or willful misconduct, liability that cannot be excluded under applicable consumer protection law, and any other liability that cannot lawfully be waived or limited. To the extent any provision of these Terms is found to conflict with a non-waivable right under applicable law, that provision is modified to the minimum extent necessary to comply with applicable law, and the remaining provisions remain in full force and effect.
9. Outfitter Standards and Obligations
Outfitters listing experiences through The Outfitter agree to the following standards as a condition of their participation on the Platform. These standards are also governed by the Vendor Agreement, which Outfitters must accept during onboarding.
9.1 Licensing and Insurance
Outfitters must hold and maintain all required licenses, permits, and certifications applicable to their services, which may include:
- State-issued outfitter or guide licenses.
- Federal permits for activities on federal lands, including National Forest, BLM, or National Park permits.
- Commercial fishing licenses and charter permits where applicable.
- Liability insurance coverage appropriate to the nature and scale of the services offered.
Off Trail Market may request proof of licensing and insurance at any time. Failure to provide current documentation may result in listing suspension.
9.2 Accurate Listing Information
Outfitters are responsible for the accuracy of all information in their listings, including:
- Experience description, location, duration, and itinerary.
- Pricing, what is included, and what is excluded.
- Group size limits and availability.
- Participant requirements, including physical fitness, licensing, age restrictions, and equipment needs.
- Cancellation and refund policy.
Outfitters must keep listings current and update availability promptly. Listing experiences that are no longer available or materially misrepresenting an experience is grounds for immediate removal and account action.
9.3 Safety Standards
Outfitters are solely responsible for the safety of participants during their experiences. This includes:
- Conducting pre-trip safety briefings appropriate to the activity.
- Maintaining equipment in safe working condition.
- Complying with all applicable safety regulations for the activity type.
- Having appropriate emergency response protocols and communication equipment for remote experiences.
- Refusing to allow participation by guests who appear impaired, unfit, or otherwise unable to participate safely.
9.4 Wildlife Law Compliance
Outfitters offering hunting or fishing experiences are responsible for ensuring that all activities conducted during their experiences comply with applicable federal, state, and tribal wildlife laws and regulations, including:
- Legal seasons, dates, and times.
- Bag limits, size limits, and possession limits.
- Legal methods of take.
- Required tagging, reporting, and documentation.
- Land access permissions and trespass laws.
Outfitters may not facilitate, encourage, or ignore illegal take of wildlife. Violations of wildlife law discovered by Off Trail Market are grounds for immediate suspension and may be reported to the appropriate wildlife agency.
9.5 Participant Treatment
Outfitters must treat all participants with respect and professionalism. Discrimination against participants on the basis of race, ethnicity, gender, religion, disability, sexual orientation, or national origin is prohibited and grounds for immediate termination from The Outfitter.
10. Disputes Between Guests and Outfitters
10.1 Direct Resolution First
If you have a dispute with an Outfitter regarding a booking, experience, or refund, your first step should be to contact the Outfitter directly through the Platform’s messaging system. Most issues can be resolved through direct, good-faith communication.
10.2 Escalating to Off Trail Market
- Your booking confirmation number.
- A clear description of the dispute and what resolution you are seeking.
- Copies of all relevant communications with the Outfitter.
- Any supporting documentation, including photographs, receipts, or medical documentation if applicable.
10.3 Legal Disputes
Any legal dispute between a guest and an Outfitter that cannot be resolved through the Platform’s dispute process is a matter between those two parties. Off Trail Market is not a party to the underlying experience contract between guests and Outfitters and is not liable for outcomes of legal disputes between them.
Any dispute between a guest or Outfitter and Off Trail Market is governed by the dispute resolution provisions of the Terms of Service, including the binding arbitration and class action waiver provisions.
11. Modifications to Bookings and Platform Terms
11.1 Outfitter Modifications
Outfitters may need to modify booked experiences due to weather, wildlife conditions, access issues, or other circumstances. Minor modifications — such as a change in start time, meeting location, or specific activity within a multi-day trip — do not entitle guests to cancellation or refund unless the modification materially changes the nature of the experience.
Material modifications — such as a significant change in location, duration, or core activity — require guest consent. If a guest does not consent to a material modification, they are entitled to cancel and receive a full refund, regardless of the Outfitter’s standard cancellation policy.
11.2 Changes to These Booking Terms
Off Trail Market reserves the right to update these Booking Terms at any time. When material changes are made, we will notify registered users via email and post the updated terms on the Platform with a new effective date. Bookings confirmed before the effective date of any changes are governed by the terms in effect at the time of booking confirmation.
12. Travel Insurance
Off Trail Market strongly recommends that guests purchase travel insurance that includes coverage for:
- Trip cancellation due to illness, injury, or unforeseen circumstances.
- Trip interruption or delay.
- Medical expenses and emergency evacuation, particularly for remote or backcountry experiences.
- Gear and equipment loss or damage.
- Weather-related cancellations where applicable.
Off Trail Market does not sell or endorse any specific travel insurance product. Guests are responsible for evaluating and purchasing coverage appropriate to their booking and personal circumstances. The existence of travel insurance does not affect your rights or obligations under these Booking Terms or the Outfitter’s service terms.
13. Governing Law
These Booking Terms are governed by the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Booking Terms that are not resolved through the Platform’s dispute process are subject to the dispute resolution provisions of the Off Trail Market Terms of Service, including the binding arbitration agreement.
